Acceptance

It is important that you read all the following terms and conditions carefully. This Terms of Use Agreement (“Agreement”) is a legal agreement between you and the HHS Health Heart Society of BC (Healthy Heart Society). It states the terms and conditions under which you may access and use the website and all written and other materials displayed or made available through the website, including, without limitation, articles, text, photographs, images, illustrations, audio clips, video clips, computer software and code (the “Content”). By accessing and using the website, you are indicating your acceptance to be bound by the terms and conditions of the Agreement. If you do not accept these terms and conditions, you must not access or use the website. The Healthy Heart Society may revise this Agreement at any time by updating this posting. Use of the website after such changes are posted will signify your acceptance of these revised terms.

Submissions


The website provides features which allow you to post messages and content to designated areas on the website, to participate in discussion groups, to interact with the Healthy Heart Society and other users and to upload files, documents, or other materials (“Submission(s)”). The Healthy Heart Society does not control the content of any Submissions and has no obligation to monitor the Submissions. While the Healthy Heart Society may attempt to delete insulting, offensive or inaccurate communications of which it is notified, it cannot prevent them and may not catch them before they cause damage, and is not responsible for such damage. However, the Healthy Heart Society reserves the right at all times to disclose any information necessary to satisfy any law, regulation, or governmental or law enforcement request, or to edit, refuse to post or to remove any Submission, in whole or in part, that, in the Healthy Heart Society’s sole discretion, are objectionable, inaccurate, misleading or in violation of the Agreement. The Healthy Heart Society will fully cooperate with any legal obligation to disclose the identity of anyone posting threatening, libelous, obscene, pornographic, profane or otherwise offensive or illegal materials. You acknowledge that you alone are responsible for the content of your Submissions and the consequences thereof. 

Passwords


You are responsible for maintaining the confidentiality of the password you use in association with your account and are responsible for all activities that occur under your user name and password. You agree to notify the Healthy Heart Society immediately of any unauthorized use of your password or account or any other breach of security, and to ensure that you exit from your account at the end of each session. The Healthy Heart Society will not be liable for any loss or damage arising from our failure or your failure to protect your password or account information.

Under no circumstances shall the Healthy Heart Society (including its directors, officers, employees, contract personnel or consultants) be liable to any individual or organization for:
  1.  Any direct, indirect, special, or consequential damages including loss of profits or loss of business opportunities that may result from access or use of the Healthy Heart Society website or information contained within the website, including the use of any services or products, or your reliance on medical or treatment information provided on or through our website, or that results from mistakes, omissions, interruptions, deletion, or corruption of files, errors, defects, delays in preparation or transmission or failure of performance; and
  2. Any loses or expenses (including legal fees) arising out of or in connection with any allegation, claim, suit or other proceeding based on a contention the use of the Healthy Heart Society website or information contained on the website by any individual or organization infringes the intellectual property rights or contractual rights of any third party.
 
The Healthy Heart Society also expressly disclaims any and all liability for the acts, omissions and conduct of any third-party user of the website, or any advertiser or sponsor of the website (“third-party”). Individuals and organizations agree to indemnify the Healthy Heart Society (including its directors, officers, employees, contract personnel or consultants) from and against any and all third party claims, demands, liabilities, costs - including legal fess, resulting from a breach of any of the provisions of the Terms and Conditions.

The Healthy Heart Society (including its directors, officers, employees, contract personnel or consultants) provides the website and content contained on the website on an "as is, where is" basis and does not make any express or implied warranties, representations, endorsement, or conditions with respect to the content published on the website, including without limitation, warranties as to the merchantability, operation, non-infringement, usefulness, completeness, accuracy, currentness, reliability, and fitness for a particular purpose.

The Healthy Heart Society is located in British Columbia, Canada and the Healthy Heart Society website is managed within British Columbia, Canada. The Healthy Heart Society promotes quality improvement and engages its partners in building a better health system.
 
Any personal information that you voluntarily provide through the completion of electronic forms on our website is collected and maintained in compliance with the British Columbia Personal Information Protection Act. Personal information collected is used only for the purpose(s) for which it was collected, and the Healthy Heart Society does not disclose this information to other organizations or individuals, except as authorized by law. You may request information collected that is not deemed personal information (e.g., attendance at training sessions and courses) be shared with an employer or accrediting agency. 

Website

When you visit our website the server may automatically collect and retain a limited amount of information essential to the efficient operation of the site. These web log files help us determine the areas of our website that are being viewed the most and provide us with statistical reports that are used to help us improve our site. Email

The Healthy Heart Society website is a public site and as such is not restricted only to users with an authorized user ID and password. As a result, any email messages sent to us though email addresses available on our site could potentially be intercepted on their way to intended recipients. The Healthy Heart Society will not be responsible for any damages suffered by organizations or individuals as a result of information that is sent via email to the Healthy Heart Society, or for any errors or changes made to information that is transmitted to the Healthy Heart Society.

The employees of the Healthy Heart Society are responsible for maintaining the confidentially of all personal and personal health information to which they have access.
